These General Terms and Conditions (the “Terms”) govern the conditions of renting the private gym FreshAura Gym Žižkov through the reservation system available at www.freshaura.cz. The provider and lessor is TroubleMakers s.r.o., registered at Jičínská 226/17, Žižkov (Prague 3), 130 00 Prague, Company ID No.: 23032901, entered in the Commercial Register maintained by the Municipal Court in Prague, File No. C 397263 (hereinafter the “lessor” or “we”). The client (hereinafter the “client” or “lessee”) is any natural or legal person who books the premises.
1.1. These Terms form an integral part of the rental agreement concluded between the lessor and the client. By completing the booking (i.e., confirming the reservation), the client acknowledges and agrees to these Terms.
1.2. The rental agreement is concluded remotely via the online reservation system on the lessor’s website. The legal relations arising from the agreement are governed primarily by Act No. 89/2012 Coll., the Civil Code, as amended.
1.3. The agreement may be concluded in Czech or English. The governing law for all legal relations arising from the rental agreement is the law of the Czech Republic.
1.4. By clicking “CONFIRM RESERVATION”, the client confirms that: (a) they have read these Terms, (b) they agree to them, (c) they acknowledge the cancellation policy and liability rules stated below.
2.1. Reservations may be made either through a user account or as a one-time reservation without registration. The data entered by the client are considered accurate and complete.
2.2. The client must protect their login credentials and may not allow third parties to misuse their account. The client is responsible for all reservations made through their account.
2.3. The lessor may cancel a user account at any time, especially in cases of long-term inactivity, violation of these Terms, or misuse of the system.
3.1. If the client uses the credit system, credits are stored in the client’s user account and may be used exclusively to purchase services provided through the platform. Credits cannot be exchanged for money or transferred to other users.
3.2. Credits are added to the client’s account either by topping up via available payment methods or as a refund related to a cancelled reservation under these Terms.
3.3. Credits are valid for 12 months from the date they are added to the account unless stated otherwise. Unused credits expire without compensation after this period.
4.1. The subject of rental is the private gym FreshAura Gym Žižkov, including equipment and sanitary facilities, intended solely for individual training and leisure activities.
4.2. The client may bring additional persons into the gym; however, a maximum of 4 personsmay be inside the gym at the same time (recommended comfort is 3 persons). The client is fully responsible for all accompanying persons.
4.3. The premises may not be used for purposes other than training and directly related activities (showers, changing clothes, etc.). Parties, commercial events, or any other activities not expressly approved by the lessor are strictly prohibited.
4.4. The following are strictly prohibited throughout the gym: smoking, consumption of alcohol or drugs, bringing animals into the premises, lighting fire, or engaging in any dangerous or unlawful activities. Recording or photographing any inappropriate or pornographic content is not permitted.
4.5. The client must behave respectfully toward neighbours and observe quiet hours between 22:00 and 06:00.
5.1. The rental agreement is always concluded for a definite period corresponding to the booked time slot. Reservations are made in time blocks, with a minimum booking duration of 30 minutes (two consecutive fifteen-minute blocks).
5.2. The rental price is displayed for each time slot in the reservation system and varies by day and time. The client agrees to pay the stated price. Current prices are available on the website in theRESERVATION section.
5.3. Payment is made exclusively online via the payment gateway. A reservation becomes valid only after the successful payment. After payment, a tax receipt will be sent electronically to the email address provided.
5.4. The client must vacate the gym no later than the final minute of the booked time. If the client exceeds the reserved period, the lessor may charge an additional fee according to the current price list, at minimum the price of the next time block.
6.1. The client may cancel a reservation at least 24 hours before the start of the booked time using the options available in the reservation system. In such cases, the client is entitled either to reschedule or to receive a refund in the form of credits (according to the currently offered options).
6.2. If the client cancels the reservation less than 24 hours before the booked time or fails to attend the reservation, they are not entitled to a refund or a replacement term unless their absence was demonstrably caused by the lessor’s breach of obligations.
6.3. The lessor may cancel or change a reservation in justified cases (equipment malfunction, technical issues, hygiene or safety reasons, etc.). In such cases, the client will be offered a replacement time or a full refund (or equivalent credits).
6.4. The client acknowledges that under Section 1837(j) of the Czech Civil Code, they are not entitled to a 14-day withdrawal right applicable to distance contracts, as the service consists of leisure activities provided at a specific date.
7.1. The client participates in all activities inside the gym at their own risk and is responsible for ensuring that their health condition allows them to exercise safely. The same applies to all accompanying persons.
7.2. At the beginning of the rental period, the client must check the condition of the premises and equipment. Any visible damage or defects must be reported immediately to info@freshaura.cz or the phone number listed on the website. If the client does not report visible defects, later-reported damage may be attributed to the client.
7.3. The client is liable for any damage caused to the equipment or premises, whether caused by the client or by persons they bring into the gym. The client must compensate the full cost of the damage, including any loss of income for the period during which the gym cannot be used due to repairs.
7.4. The lessor is not liable for theft or damage to the client’s belongings or those of accompanying persons, unless the damage was caused by the lessor’s proven breach of duty.
7.5. Persons under 18 years of age may enter the gym only when accompanied by an adult who assumes full responsibility.
8.1. If the client believes that the service was provided defectively (e.g., equipment malfunction preventing exercise, serious hygiene issues), they must report the defect without undue delay, no later than the day following the reserved time, to info@freshaura.cz.
8.2. The client must describe the defect and attach documentation if available. The lessor will review the complaint and inform the client of the resolution. In case of a justified complaint, the client may be offered an appropriate discount, a replacement reservation, or a refund.
8.3. The client is not entitled to rights from defective performance if they caused the defect or knowingly used the service despite being aware of the defect.
9.1. These Terms are effective as of 16 November 2025 and replace all previous versions applicable to FreshAura Gym Žižkov.
9.2. The lessor may amend these Terms unilaterally. The current version is always available at www.freshaura.cz. Amendments do not affect previously concluded agreements unless the parties agree otherwise.
9.3. Matters not expressly regulated by these Terms are governed by the laws of the Czech Republic. The parties agree to attempt to resolve any disputes amicably; if no settlement is reached, the dispute will be resolved by the competent Czech court.
